Information in accordance with Art. 13, 14 and 21 of the Basic Data Protection Regulation (DSGVO)

 

No matter if you are our customer or if you are interested in my web offer for other reasons: The protection of your privacy is important to me. Here you can find out which personal data I collect from you when you visit my website including the sub-websites for which purposes, how I process the data and how I protect it. I also inform you about the rights you have to protect your data.

As an HR consultant and lawyer, I advise and support companies in all questions concerning human resources. As the operator of this website I am responsible in terms of data protection law. My contact details are:

2. Which data do I use and where do I get them from?

 

When I process personal data, this means that I collect, store, transmit, delete or use this data in any other form. By personal data, I mean information about natural persons, for example

all other persons who are in contact with me, e.g. employees of authorities, messengers as well as representatives or employees of my business partners or service providers.

3. How do I process your data and on what legal basis?

 

Data processing when visiting my website

 

In the case of merely informational use of the website, I process the above-mentioned usage and protocol data. These are technically necessary to display my website and to guarantee stability and security.

 

In the case of illegal use of my offer, the protocol data also serve to clear up possible legal violations. This happens for example in case of attacks on my internet infrastructure. I use your data in these cases to fend off the attack and to determine the origin of the attack with the aim of taking criminal and civil action against the persons responsible and to be able to prevent future attacks more effectively.

 

The processing is carried out on the basis of a balancing of interests, which always takes your interests into account (Art. 6 para. 1 sentence 1 lit. f) DSGVO).

 

Use of cookies

 

This website uses cookies. Cookies serve to make my offer more user-friendly, effective and safer. Cookies are text files that are stored on your computer in the internet browser or by the internet browser. The cookie contains a string of characters that allows a unique identification of your system when you visit the website again. They are used to control the Internet connection during your visit or during a later visit to my website and thus make the visit more comfortable for you.

 

Some elements of my website require that the calling browser can be identified even after a page change. Some cookies remain stored and enable me to recognize your browser on your next visit. In particular, your settings when using my website are stored and transmitted in the cookies.

 

The data collected with the help of such technically necessary cookies is not used to create user profiles.

Most of the cookies used by me ("session cookies") and the data stored and transmitted in them are automatically deleted at the end of your visit. Other cookies ("persistent cookies") remain stored on your terminal device until you delete them.

 

Some browsers already allow cookies in their default settings. If you do not wish to have them, you can change the settings of your browser.

How this is done can be found in the information provided by the browser manufacturer (e.g. via the help function). If you decide against cookies, it may happen that parts of my internet offer cannot be used.

 

Social Media Plugins

 

I currently only use social media plugins from LinkedIn. I use the so-called 2-Click solution. This means that when you visit my site, no personal data is passed on. Only if you click on one of the plugins, data is transmitted to the respective provider of the plugin. You recognize the offerer of the Plugins over the marking on the greyed out box on the basis the initial letter.

 

By activating the plug-in, the respective provider receives the information that your browser has called up the corresponding page of my website, even if you do not have an account with this provider or are not logged in. This information (including the data mentioned in letter a) of this declaration) is transmitted by your browser directly to a server of the provider in the USA and stored there.

 

If you are logged in with this provider, the provider can directly attribute your visit to our website to your account with this provider. If you interact with the plug-ins (e.g. leave a comment), the corresponding information is also transmitted directly to a server of the provider and stored there. The information is also published on the provider's site and displayed to your contacts. If you do not want the provider to assign the data collected on our website to your user account, you must log out of the provider's website before the first use of the plug-in.

 

The provider may use this information for the purpose of advertising, market research and demand-oriented use of its websites. How do I process your data when you contact me?
 
My offer allows you to contact me. This can be done, for example, by providing me with a phone number, fax number or sending me an e-mail. The information you provide when contacting me, such as name, company, address, e-mail address and telephone number, will be stored in order to process your inquiry and any subsequent correspondence. The processing is carried out either to fulfill a contract (Art. 6 para. 1 lit. b) DSGVO) or on the basis of a weighing of interests (Art. 6 para. 1 lit. f) DSGVO), which always takes your interests into account.
 
For what other purposes do I process your data?
 
Where necessary, we process your data beyond the provision of our website, in particular for the following purposes:
- Assertion of legal claims and defence in legal disputes
- Guarantee of IT security
- Prevention and investigation of criminal offences
 
The processing is based on a balancing of interests, which always takes into account your legitimate interests (Art. 6 para. 1 lit. f) DSGVO).

I will only pass on your personal data if you have expressly consented to this, if there is a legal basis for this or if this is necessary to enforce my rights, in particular to enforce or defend claims.
 
Service providers I employ may also receive data for the above-mentioned purposes if they comply with the data protection requirements. These can be especially companies in the categories IT services and telecommunications.

5. When do I delete your data?
 
I delete your data when they are no longer needed for the purposes for which they were originally collected. For example, I always delete your usage and log data after your visit to our website, unless we are permitted to process this data, for example, to defend and track attacks. I delete your data from inquiries if they are no longer required after successful processing. In addition, I will store your data even after the original purpose of collection has ceased to apply if I am obliged (e.g. for archiving purposes) or entitled (e.g. for legal prosecution purposes) to store the data for other reasons.

- the right according to Article 16 DSGVO,
- the right according to article 17 DSGVO,
- the right according to article 18 DSGVO
- and the right according to article 20 DSGVO.
 
With regard to the right of information and the right of cancellation, the restrictions according to §§ 34 and
35 BDSG. You also have the right to complain to a data protection supervisory authority (Article 77 DSGVO in conjunction with § 19 BDSG).

 

8. Will I use your data for automated decisions in individual cases, including profiling?
 
I will not process your data either for automated decisions in individual cases or for profiling.

 

9. Data Security

 

I use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. My security measures are continuously improved according to technological development.

 

10. Information about your right of objection according to article 21 of the basic data protection regulation (DSGVO)

 

Right of objection in individual cases

You have the right to object at any time, for reasons arising from your particular situation, to the processing of personal data concerning you, which is carried out on the basis of Article 6 paragraph 1 e) DPA (data processing in the public interest) and Article 6 paragraph 1 f) DPA (data processing based on a balancing of interests); this also applies to profiling within the meaning of Article 4 No. 4 DPA based on this provision.
 
If you lodge an objection, I will no longer process your personal data unless I can prove compelling reasons for processing worthy of protection that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
 
Objection to the processing of your data for our direct marketing

 

I do not currently process your personal data for direct marketing purposes. However, I would like to inform you that you have the right to object at any time to the processing of your personal data for the purpose of such advertising, including profiling, insofar as it is connected with such direct marketing.
